If Someone Gets Served - What Does That Mean For Them

First of all, everyone will EVENTUALLY be served. Everyone we've ever talked to hated "avoiding" the service processor. So we suggest (2) choices:

1. When asked if One is _____________ - simply reply with "What's this in regards to?" and just keep asking questions until they state they are a process server. Once they state that, tell them _____________ will never accept papers at this location and to never come back unless they want to violate Private Property & Trespassing Laws.
  • Process servers can't lie about who they are and what they're trying to do, especially by posing as law enforcement. While they can be 'general' about who they are, they cannot serve papers or gain access to a person under false pretenses and must follow all state and federal laws.
2. Just accept the papers from Day 1. It doesn't matter if the debt collector even gets a judgment against one in court - they won't be pursing much past that when they see a Defendant file as an Indigent (having no money). Additionally, if protecting assets with a trust - there will literally be NOTHING TO LOSE!
  • We prefer this method because we've found the "fear of being served" is actually worse than just facing the matter head-on. Additionally, it gets most clients moving on filing their lawsuits the very next day. This means finding a solution in 2-3 months from now, rather than years of playing "cat and mouse".
