The Debt Collector / Attorney / Law Firm Says They Represent The Original Creditor
Unless they are
the original creditor themselves - this is doubtful. The debt collector can legally say
they “represent the original creditor” because a debt buyer may go forward
under the authority of the original creditor to pursue a debt. Thus, students will see ABC
Law Firm representing Chase Bank in the letterhead or footer of letters
received. In reality, these firms cannot contact the original
creditor to obtain further validation or contracts that were not originally sent
in the bulk debt purchase. Does that sound like they TRULY represent the original creditor? These attorneys always call their employer (a
higher-up in the debt collection agency) to get the "go ahead" to
drop the case when leaving the room during mediation. If they actually called
the original creditor to obtain information on the account, one could sue!
