Who Should Be Sued For Invalid Debt Verification & Validation

If one has received a letter, call the phone number listed and inquire regarding the basic information needed: 1) amount of the debt, 2) name of the current debt owner and 3) information to contact the original creditor. If this information is not provided during the phone call, then legally within (5) days they are required to provide a written email or letter regarding the debt.

When the debt has been sold, sue the agency or law firm that has reached out regarding the debt. When the original creditor still holds the debt, sue the original creditor. If it is unknown whether the debt has been sold, the validation letter sent to the original creditor will get the correct party involved.

If no letter has arrived, call the original creditor who issued the line of credit to inquire regarding the basic information needed: 1) amount of the debt and 2) name of the current debt owner.
